Terms and conditions

1. Acceptance

By using the website, creating an account or buying a paid listing or advertising service from us (together, the "Service"), you agree to these terms. If you do not agree, please stop using the Service. If you are acting for a business, you confirm you have authority to bind it; if you are acting as an individual, you confirm you are of legal age to enter a contract.

2. The Service

Yarm.co.uk is an independent guide to Yarm, comprising a business directory, editorial guides and events information. Business owners may claim a listing and subscribe to an Enhanced Listing, which adds richer media, an offer, an enquiry form, a clearly labelled priority position within its category and an AI-assisted description writer. We are not a council, tourism authority or other public body.

3. Your account

You must give accurate information and keep it up to date, keep your login credentials confidential, and accept responsibility for activity under your account. Tell us promptly if you suspect unauthorised access.

4. Acceptable use

You must not:

• use the Service unlawfully, or for fraud, spam or misleading claims;
• submit content that infringes anyone's intellectual property or other rights;
• interfere with the security or integrity of the Service, including malware, probing, penetration attempts, automated scraping or circumventing technical limits;
• impersonate another business, or list a business you are not authorised to represent;
• reverse engineer, resell or redistribute the Service.

5. Your content

You keep ownership of the business details, text and images you submit, and you confirm you have the rights to use them. You grant us a non-exclusive licence to host, adapt for display and publish that content for the purpose of providing the Service and promoting the listing on Yarm.co.uk. You are responsible for the accuracy of anything you publish, including prices, opening hours and offers.

6. The description writer (AI)

The description writer uses an AI model to turn the details you provide into draft wording. You are responsible for the details you enter, for holding the rights to any content you submit, and for reviewing and verifying every description before it is published. Output may be inaccurate or incomplete and must not be relied on as professional, legal, financial or regulated advice. You must not use it to generate unlawful, deceptive, infringing, hateful or harassing content, nor attempt to bypass its safeguards. We may refuse, filter, edit or remove output and content, and may suspend accounts for repeated or serious misuse. If you believe content on the site infringes your rights, contact us and we will investigate and remove infringing material; repeat infringement leads to termination.

7. Our intellectual property

We retain all rights in the Service, including its software, design, editorial content, compilation of directory data, documentation and branding. Your subscription grants a limited, non-exclusive, non-transferable right to use the Service within the plan you have bought.

8. Payment and subscriptions

Enhanced Listings are sold as a monthly subscription that renews automatically until cancelled. You may cancel at any time; paid features continue until the end of the period you have already paid for. Prices are shown at checkout and include VAT or sales tax where applicable.

Payment, billing, tax, invoicing, cancellation and refund mechanics are governed by Paddle's Checkout Buyer Terms. See also our refund policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Service levels

We work to keep the Service available and accurate, but we do not guarantee that it will be uninterrupted, timely, secure or error-free. To the fullest extent permitted by law we exclude all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may close your account at any time. On termination your enhanced features end, and listing content may be removed; you can ask for a copy of your submitted content within 30 days.

11. Liability

We are not liable for indirect, consequential or special losses, including loss of profits, revenue, data or goodwill. Our total liability in connection with the Service is limited to the fees you paid in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

12. Indemnity

You will indemnify us against claims, losses and reasonable costs arising from content you submit, your unlawful use of the Service, or your breach of these terms.

13. Changes

We may update these terms and will post the revised version here with a new date. Continued use after the change takes effect means you accept the updated terms.

14. General

You may not assign this agreement without our consent; we may assign it as part of a merger, acquisition or reorganisation. Neither party is liable for delay caused by events beyond its reasonable control. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
